O evento contará com a participação de líderes nacionais e internacionais que irão fomentar o debate voltado ao seguinte tema: “Force Majeure Revisited: lidando com o imprevisível”. A apresentação será feita em inglês em 4 painéis, das 9h às 12h15, nos dias mencionados anteriormente.

Este ano, excepcionalmente, o evento será gratuito e, ao invés de taxa de inscrição, recomendamos aos inscritos a realização de uma doação, de qualquer valor, à Casa José Coltro (www.casajosecoltro.org.br), uma ONG que atua desde 1988 no Capão Redondo e tem por objetivo gerar um impacto social transformador, através do acolhimento, formação e integração dos alunos com a sociedade e o mercado de trabalho.

O Congresso será realizado nas mesmas datas originalmente agendadas para a Conferência Anual Internacional ICLA IBDiC, que seria feita presencialmente em São Paulo, mas devido a situação atual foi adiada para o ano de 2021.

It is with great pleasure that we invite you to the virtual conference to be held in partnership between the International Construction Law Association (ICLA) and Brazilian Institute of Construction Law (IBDiC).This conference will bring together leading international and Brazilian speakers to discuss various topics related to the central theme: “Force Majeure Revisited: Dealing with the Unpredictable”. The discussions will be held in English in four panels across the two days mentioned above from 2:00pm to 5:15pm Central European Time.

This year, as an exception, registration is free although we ask that a voluntary donation of any amount is made to the charity Casa José Coltro (www.casajosecoltro.org.br). Since 1988, Casa José Coltro has been working to help underprivileged children and adolescents in Brazil to have a better education and integration into society and the work place.

This virtual conference is being held on the same dates originally scheduled for the joint ICLA/IBDiC conference that was due to be held in person in São Paulo but had to be postponed until next year due to the current circumstances.

Wolfgang Breyer

Dr. Wolfgang Breyer is a leading German and International Construction lawyer and founder of Breyer Rechtsanwälte – one of the only the specialist construction law firms with offices located across Europe. As Managing Partner, Dr. Breyer has been a pioneer in bringing together the civil and common law jurisdictions to solve complex legal problems, and he is acknowledged as one of the world’s most experienced International Construction lawyers with particular expertise in international construction contracts (FIDIC, PPC, et al.). Professor David Mosey

Professor David Mosey PhD is Director of the King’s College London Centre of Construction Law and Dispute Resolution, part of the Dickson Poon School of Law, and is former Head of Projects and Construction at Trowers & Hamlins solicitors.

With over 30 years’ experience advising on UK and international construction projects, David has been described in the Chambers Guide to the Legal Profession as a “partnering guru” who “gives something to the industry“. He is principal author of the “PPC2000” collaborative contracts and of the “FAC-1” and “TAC-1” alliance contracts, adopted so far on procurements worth over £42 billion. David’s work on FAC-1 was shortlisted for the 2017 King’s Award for “Research Project of the Year”.

David jointly led the UK Government “National Change Agent” team from 2005 to 2011, using consortium procurement to secure substantial cost savings, energy-efficient designs and new apprenticeships. From 2012 to 2018 he was “lead project mentor” for the UK Government trials of “Two Stage Open Book” procurement, testing the savings and other benefits achieved through the combination of early contractor involvement, collaborative working and Building Information Modelling.

David’s latest book “Collaborative Construction Procurement and Improved Value” was published in April 2019 and explores integrated systems and relationships through 50 case studies across seven jurisdictions.

David won the UK Constructing Excellence “Achievers Award” 2009 and the 2015 Association of Consultant Architects medal for services to the practice and profession of architecture.

He has been practicing law for engineering and construction contracts in the real estate and infrastructure sector since 2003. He was recognized for his professional prominence in construction law by the British specialist publication “Practical Law Company” in the 2009 and 2010 editions.

Zhao Dongfeng

Doug Jones

Doug Jones AO is a leading independent international commercial and investor-state arbitrator with over 40 years’ prior experience as an international transactional and disputes project lawyer. Doug is an arbitrator member at Arbitration Place in Toronto, a door tenant at Atkin Chambers London and has an office in Sydney. Doug is also an International Judge of the Singapore International Commercial Court.

He has been involved in over 130 arbitrations which include construction, infrastructure, energy, commodities, intellectual property, joint venture, and investor-state disputes spanning over 30 jurisdictions around the world. He has extensive experience as arbitrator under the ICC, LCIA, AAA, ICDR, KCAB, AIAC (formerly KLRCA), CRCICA, SIAC, VIAC, SCC, DIAC, ACICA, IAMA, AMINZ, European Development Fund Arbitration and Conciliation Rules, as well as the ICSID and UNCITRAL Rules, in disputes of values exceeding some billions $US.

Prof Stefan Leupertz

Prof Stefan Leupertz is a former Judge of the German Supreme Court and known as one of the leading legal authorities on construction law in Germany. During his tenure as a Judge of the German Supreme Court, Prof Leupertz was assigned to the Seventh Civil Division, being responsible for hearing construction, contract and architectural law disputes. In 2012 Prof Leupertz resigned as Judge of the German Supreme Court and commenced his own practice

Leupertz Baukonfliktmanagement with the focus purely on construction law – in particular, dispute avoidance and dispute resolution as arbitrator, adjudicator and legal expert. Prof Leupertz is particularly active and highly respected in academia being co-editor of the German construction law journal, Baurecht and editor/author of numerous other standard-publications on German construction law. Janet Walker

Janet is an independent arbitrator with chambers at Arbitration Place, Toronto; Int-Arb Arbitrators, London; and Sydney Arbitration Chambers, Australia. Janet has served as sole arbitrator, co-arbitrator and chair in ICC, ICDR, DIAC, HKIAC, KCAB and SIAC-administered, and in ad hoc arbitrations in a variety of seats. Her matters range from construction, M&A, shareholder, intellectual property, pharma and environmental. She has a good working knowledge of Spanish and French.

Janet is professor of law (past associate dean) at Osgoode Hall Law School, a member of the Ontario Bar, and a licensed legal consultant of the New York State Bar. She authors Canada’s main text on private international law, cited in more than 350 judgments. She is chair-elect of ICC Canada and a member of the Board of the International Construction Law Association.

Aisha Nadar

Ms. Nadar is active in large-scale cross-border infrastructure and defence programs. For over thirty years she has handled all phases of their negotiation and implementation. She advises clients on strategic procurement planning, contract drafting, contract management and dispute resolution. She acts as arbitrator, mediator, adjudicator and Dispute Board member and has experience as president and member of tribunals under ICC, SCC, DIAC, AAA and UNCITRAL rules.  She is listed on the Panel of Conciliators at the International Centre for Settlement of Investment Disputes (ICSID) and the FIDIC President’s list.  She has carried out dispute resolution assignments  for organizations such as the World Bank, USAID and US DoD and many commercial players.  Ms Nadar holds a BS degree in Electrical Engineering (University of Nebraska),  an MBA (University of Texas-Austin) and an LL.M. in International Commercial Dispute Resolution (Queen Mary, University of London).

Eduardo Parisi

Eduardo Parisi is a Postdoctoral Research Fellow in Administrative Law at the University of Milan where he carries out a research project on alliancing and collaborative behaviours in contractual relationships.

During his PhD in Administrative Law (University of Milan – 2014-2017) he deepened the subject of co-administration among public institutions at the European level.

He holds an LLM in Legal Theory – NYU School of Law. His research focus was on environmental law and global administrative law.

He is the Responsible for the International Relationships of the European Association of Public Private Partnership and contributes to the initiatives of the network lecturing in international conferences on the issues of public private partnership.

As a member of the Transnational Alliancing Group, he is working with several academics and professionals on collaborative procurements in a global perspective.

As an attorney at law, he worked with numerous public administrations, on projects of public procurement, land use and environmental law.

David Brown

David is a partner with Clyde & Co based in Paris. He is both an English Solicitor and French Avocat, and has more than 25 years of experience in construction dispute resolution across five continents, with a particular focus recently on the Middle East and Africa. His experience in dispute resolution, which ranges from infrastructure to hydro-electric and nuclear projects, includes international arbitration (particularly ICC arbitrations), in which he acts as both counsel and arbitrator. He is also active in dispute board proceedings as both panellist and counsel, and is on both the FIDIC President’s List of Approved Dispute Adjudicators and its French List.

David is listed in Who’s Who Legal as one of the leading construction lawyers in France. He is a visiting lecturer for the Stuttgart University Masters course in international construction law, and is a Council Member of the ICC Institute of World Business Law, a Director of the International Construction Law Association, and a Fellow of the International Academy of Construction Lawyers.

Howard Ashcraft

Howard Ashcraft has led in the development and use of Integrated Project Delivery and Building Information Modeling in the United States, Canada and abroad.  Over the past decade, his team has structured over 160 pure IPD projects and worked on many highly-integrated projects.  He is active in the Lean community and regularly presents and participates in Lean conferences. He co-authored the AIACC’s Integrated Project Delivery: A Working Definition, the AIA’s IPD Guide and the text, Integrating Project Delivery (Wiley 2017) Integrated Project Delivery: An Action Guide for Leaders (Pankow Foundation 2018) and chaired subcommittees for the National Building Information Modeling Standard (NBIMS).  A partner in the San Francisco law firm of Hanson Bridgett, he is an elected Member of the National Academy of Construction, a Fellow of the American College of Construction Lawyers, an Honourary Fellow of the Canadian College of Construction Lawyers, a Fellow of the American Bar Foundation and an Honorary Member of AIA California Council.  In addition to his professional practice, he serves as an Adjunct Professor of Civil and Environmental Engineering at Stanford University and is the Module Leader for Commercial Leadership at the Saïd Business School at Oxford University.

Paula Forgioni

Professor and Head of the Department of Commercial Law at the Faculty of Law of the University of São Paulo. She is specialized in Business Law from the Law Faculty of the University of Bologna and International Trade Law from the University Institute of European Studies of Turin. Acted as visiting professor at the University of Florida. After a long career advising on business law, today acts primarily as an arbitrator and expert evidence referee. Author of several works on business and competition law, in particular “Business contracts. General theory and application”; “The fundamentals of antitrust” and “The evolution of Brazilian commercial law. From merchant to the market.”
